This is a vacation rental governed by the North Carolina Vacation Rental Act. Kismet Cottage, located at 205 Cherokee Road, Pinehurst, NC 28374 (Moore County), is owned by 205 Cherokee Road, LLC and rented through its authorized agent. By completing a booking and submitting payment, you accept these terms and enter into a vacation rental agreement under the Act. The parties agree that electronic means may be used to enter into and communicate about this agreement.
These terms summarize the full North Carolina Vacation Rental Agreement (Standard Form 411-T) that governs your booking. In the event of any conflict, the signed agreement controls.
Equal Housing
All bookings are handled without regard to race, color, religion, sex, national origin, handicap, familial status, sexual orientation, or gender identity.
Booking & Eligibility
- The booking guest must be at least 30 years of age and must occupy the property for the duration of the stay.
- Maximum occupancy is 14 guests, including children.
- The property may be used for residential purposes only, and not for any activity that violates criminal law or governmental regulation.
- The booking may not be assigned, and the property may not be sublet in whole or in part, without written permission.
Payment Terms
- A deposit of 50% of the total booking amount is due at the time of booking; the remaining balance is due 14 days before check-in.
- Applicable North Carolina and Moore County occupancy taxes are collected with your booking. Guests are responsible for all applicable taxes at the rates in effect at the time of occupancy.
- Advance payments are deposited in a trust account as required by the Vacation Rental Act. Any interest earned on advance payments accrues to the benefit of the owner.
House Rules
- Check-in: 3:00 PM or later. Check-out: 12:00 PM (noon).
- No pets are permitted (service animals excepted). A breach of this provision is considered material and may result in termination of the tenancy.
- No smoking inside the property.
- No parties or events without prior approval.
- Quiet hours are 10:00 PM to 8:00 AM.
Guest Duties; Damage & Liability
As required by the Vacation Rental Act, guests agree to keep the property as clean and safe as conditions permit, not to create unsafe or unsanitary conditions, and not to deliberately or negligently destroy, deface, damage, or remove any part of the property or knowingly permit any person to do so. Please notify us in writing if a smoke detector needs replacement or repair. Guests are responsible for any damages beyond normal wear and tear, and agree to indemnify and hold harmless the owner and agent from liability for personal injury or property damage sustained by any person as a result of any cause, unless caused by the negligent or willful act of the owner or agent.
Property Condition
The owner is required to provide the property in a fit and habitable condition. If at check-in the property is not fit and habitable and a reasonably comparable property cannot be substituted, all payments made will be refunded.
Right of Entry
The owner, agent, or their representatives may enter the property at reasonable hours to inspect, make repairs, alterations, or improvements, or to show the property to prospective purchasers or tenants.
Mandatory Evacuation
If state or local authorities order a mandatory evacuation of an area that includes the property, guests must comply with the order. Upon compliance, guests will receive a prorated refund for each night they are unable to occupy the property because of the order.
Cancellation
Cancellations are handled per our Cancellation Policy. We recommend guests consider trip interruption or travel insurance, which may provide coverage for losses in the event of a cancellation or evacuation.
Expedited Eviction; Governing Law
For tenancies of 30 days or less, the expedited eviction procedures of the Vacation Rental Act apply to material breaches of these terms. This agreement is governed by the laws of the State of North Carolina, and any legal action may only be instituted in the county where the property is located.
